These General Terms and Conditions (GTC) apply to all deliveries from Damina Performance to consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB).
A consumer is any natural person who enters into a legal transaction for purposes that are neither related to their commercial nor their independent professional activity. A business is a natural or legal person or a legally capable partnership that, when entering into a legal transaction, acts in the course of its commercial or independent professional activity.

3.1. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Errors excepted.
3.2. By clicking the "Buy" or "Order with obligation to pay" button, you submit a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order follows immediately after the order is submitted. The contract language is German.
We offer special conditions for businesses (B2B). To qualify, a merchant account with a valid VAT ID number must be registered and verified by us. The statutory provisions apply to businesses unless these terms and conditions stipulate otherwise (exclusion of the right of withdrawal for businesses).
5.1. The prices stated on the product pages include statutory VAT and other price components (consumers) or are exclusive of VAT (for logged-in B2B users).
5.2. In addition to the prices shown, we charge shipping costs for deliveries within Germany. These shipping costs will be clearly displayed again on the checkout page.
Delivery is available within Germany and to selected European countries. Delivery typically takes 1-3 business days. Any differing delivery times will be indicated on the respective product page.
Payment can be made via PayPal, credit card, Klarna, prepayment or invoice (only B2B after activation).
The goods remain our property until full payment is received.
9.1. The statutory warranty regulations apply to consumers.
9.2. For businesses, the limitation period for claims based on defects is one year from the transfer of risk. Businesses must report obvious defects immediately.
